1. Description of Service

NextMark Studio provides a Figma plugin and web service that utilizes Artificial Intelligence to convert design files into Tailwind CSS code. The service is provided "as-is" and "as-available." While our AI aims for high accuracy, we do not guarantee that the generated code will be 100% error-free or a pixel-perfect match for the original design.

2. User Accounts & Security

To use the service, you must authenticate via Figma and our platform. You are responsible for maintaining the confidentiality of your session tokens and account access. We utilize verifyUserToken protocols to secure your data; however, any unauthorized use of your account is your responsibility.

3. Intellectual Property

• Your Designs: You retain all ownership and intellectual property rights to the Figma designs you submit to the service.

• Generated Code: Upon successful payment of your subscription or one-time fee, [Your App Name] grants you a non-exclusive, worldwide, royalty-free license to use, modify, and distribute the generated Tailwind CSS code in your personal or commercial projects.

• AI Training: We do not use your proprietary designs to train our underlying AI models without your explicit opt-in consent.

4. Payment, Refunds, and Subscriptions

Payments are processed securely via Stripe or Paddle.

• Billing: Subscriptions automatically renew unless canceled at least 24 hours before the end of the billing cycle.

• Refunds: Due to the digital nature of AI generation and the immediate availability of code exports, all sales are final. We do not offer refunds for partial subscription periods.

5. Usage Limits and Temporary Storage

To maintain system performance, we enforce usage limits based on your plan tier.

• Temporary Data: Files generated for export (ZIP files) are stored in a temporary Google Cloud Storage bucket and are automatically deleted after 15 minutes. It is your responsibility to download your exports promptly. We are not liable for data loss resulting from the expiration of these temporary links.

6. Prohibited Conduct

You agree not to:

• Use the service to generate malicious code.
• Attempt to reverse-engineer the plugin or the AI conversion logic.
• Share a single-user license across multiple individuals.

7. Limitation of Liability

NextMark Studio, its developers, and affiliates shall not be liable for any indirect, incidental, or consequential damages (including loss of profits or business interruption) arising out of the use or inability to use the AI-generated code. Our maximum liability shall not exceed the amount you paid for the service in the six months preceding the claim.

8. Governing Law

These terms are governed by the laws of Dubai, United Arab Emirates. Any disputes shall be settled in the courts of Dubai.
